We believe that computerized or other graphic presentations are no less valuable in mediations and arbitrations than in trials, and that failure to consider and utilize such elements in alternative dispute resolution can surrender a readily available instrument for enhancing counsel’s chances for success.

While mediators and arbitrators might be thought generally to be a more sophisticated audience, legally, than the average jury, the graphic presentation of evidence and arguments can be every bit as helpful for such decision makers. Effective graphic presentation of one’s case can be very influential with such targets, as a means directly of substantiating counsel’s arguments regarding the value of a case or claim, and as a means of illustrating the type of presentations that will be made to a jury should the matter not be resolved in the ADR forum.
